Please Read Before Ordering
These Terms form part of your agreement with TN Pools LeisureScapes. A product order, quotation, work order, service authorization, installation agreement, invoice, financing document or manufacturer warranty may contain additional terms. If a signed project-specific agreement conflicts with these general Terms, the project-specific agreement governs to the extent of the conflict. Nothing in these Terms limits a right or remedy that cannot legally be limited under Ontario or Canadian law.
In these Terms, “TN Pools,” “TN Pools LeisureScapes,” “we,” “us” and “our” refer to the business operating under the TN Pools LeisureScapes name. “Customer,” “you” and “your” refer to the person or organization purchasing or requesting products or services. “Products” includes pools, hot tubs, robotic cleaners, equipment, parts, accessories, chemicals and other merchandise. “Services” includes consultations, installations, openings, closings, maintenance, repairs, relocations, diagnostics, water testing and related work.
By placing an order, approving a quotation, booking a service, authorizing work, accepting delivery or using a website that links to these Terms, you agree to be bound by these Terms and any applicable project-specific documents.
These Terms are intended to operate only to the extent permitted by applicable law. Nothing in these Terms excludes, restricts or waives any non-waivable warranty, cancellation right, refund right, remedy or other protection available under the Consumer Protection Act, 2002, its regulations or other applicable law. Where the law requires a different result, the law governs.
Important Pricing Protection
We work to keep prices, promotions, product descriptions, availability, shipping charges and other information accurate. However, typographical, technical, supplier, data-entry, calculation or system errors may occasionally occur.
All orders are subject to verification and acceptance by TN Pools. An automated email, payment authorization, cart confirmation or order number acknowledges receipt of your request but does not by itself constitute acceptance of the order. For a product order, acceptance occurs when TN Pools expressly confirms acceptance in writing, releases the product for pickup or ships the product, whichever occurs first. For an installation or service project, acceptance occurs when the applicable quotation, work order or project agreement is accepted by TN Pools in accordance with its terms.
Before acceptance and subject to applicable law, TN Pools may refuse, correct or cancel an order affected by an incorrect price, description, discount, shipping charge, tax calculation, inventory status or other material error. TN Pools may also refuse or cancel an order where a product is unavailable, a supplier cannot fulfill it, quantity limits apply, delivery is not reasonably available, fraud or unauthorized activity is suspected, or the order cannot lawfully or safely be completed.
If TN Pools cancels an order after receiving payment, TN Pools will promptly refund the amount paid for the cancelled portion using the original payment method where reasonably possible. TN Pools will not charge a higher corrected price without the customer’s agreement. If an error is discovered after an order has been accepted, TN Pools will contact the customer and will proceed, modify or cancel only with the customer’s agreement or as otherwise permitted by applicable law.
Inventory, colours, patterns, models and specifications may change without notice. Displayed availability is not guaranteed until an order is accepted. TN Pools will not substitute a materially different product without the customer’s approval, except for minor manufacturer changes that do not materially reduce function, quality or value.
Photographs, monitor colours and samples are illustrative. Natural variation, manufacturing tolerances and production changes may cause reasonable differences in colour, pattern, texture, dimensions or appearance.
Deposit and cancellation terms stated in a quotation, work order or project agreement form part of the customer’s contract and take priority over this general section.
Subject to statutory cancellation rights, a deposit may become non-refundable to the extent TN Pools has incurred non-recoverable costs, reserved labour, completed design or administrative work, ordered products, accepted supplier charges or started fabrication or performance. Any cancellation charge will be applied only as permitted by law and the applicable written agreement.
Special-order, made-to-measure, configured, cut, tinted or personalized products—including custom liners, covers and specially ordered equipment—may not be cancellable or returnable after ordering or production has begun, except where defective, incorrectly supplied or otherwise required by law.
Returns and exchanges are subject to the policy disclosed at checkout, on the receipt, in the quotation or at the time of sale. Proof of purchase may be required. Products must be unused, complete, undamaged and in their original packaging unless a different result is required by law.
For health, safety, quality-control or resale reasons, opened chemicals, opened water-care products, installed electrical or mechanical parts, used equipment, clearance items, gift cards and custom or special-order products may be final sale unless defective or otherwise returnable by law. Shipping, delivery, installation, diagnostic and service charges already performed are not refundable unless required by law or agreed in writing.
The exact products, services, exclusions, price, payment schedule and expected timing for an installation or service project will be set out in the applicable quotation, work order or project agreement. Website descriptions and general package summaries do not replace the project-specific written scope.
Unless included in writing, TN Pools is not responsible for electrical, gas, plumbing beyond the stated pool scope, municipal fees, engineering, surveying, fencing, landscaping, deck work, water supply, restoration of lawns or driveways, relocation of privately installed services, removal of unknown buried materials or other work outside the agreed scope.
The customer must, as applicable:
Responsibility for permits, utility locates, surveys, engineering, inspections and municipal or conservation-authority approvals will be allocated in the project-specific agreement. If that agreement does not address an item, the customer is responsible for confirming what approvals apply before work begins, and TN Pools will cooperate reasonably with information relating to its scope.
Public utility locates do not necessarily identify privately installed lines or systems. The customer must disclose and, where required, arrange identification of private utilities and buried features. TN Pools is not responsible for damage to undisclosed or incorrectly identified private systems except to the extent caused by TN Pools’ negligence or otherwise imposed by law.
Conditions that could not reasonably be confirmed before work—such as rock, groundwater, unstable or contaminated soil, buried concrete or debris, hidden damage, undocumented utilities, unsuitable backfill, restricted access or defects in existing construction—may require a change in method, materials, price or schedule.
Material additions, deletions or changes to the agreed work should be documented in a written change order or other written authorization describing the change and, where reasonably available, its effect on price and timing. Emergency work reasonably required to protect people or property will be handled in accordance with applicable law and the project agreement.
Installation and service timing can be affected by weather, ground conditions, inspections, permit processing, product availability, supplier or carrier delays, labour disruption, utility work, fire, flood, public-health events, government action, equipment failure and other events beyond reasonable control. TN Pools may adjust the schedule where reasonably necessary and will communicate material changes. Estimated dates are not guarantees unless expressly stated as guaranteed in a signed agreement. This section does not remove any cancellation or refund right provided by applicable law.
The customer should inspect completed work as soon as reasonably possible and notify TN Pools promptly in writing of an alleged deficiency, with photographs or other useful details where available. Prompt notice gives TN Pools an opportunity to inspect and, where responsible, correct the issue before it worsens or is altered by another person.
Minor outstanding items that do not prevent safe and substantial use do not by themselves invalidate completion of the main work, subject to applicable law and any holdback or payment rights in the project agreement.
Many products are covered by a manufacturer warranty. Warranty duration, coverage, registration requirements, exclusions, parts, labour and transportation are determined by the manufacturer’s written warranty. The customer is responsible for completing required registration and keeping proof of purchase.
Any TN Pools workmanship warranty is limited to the warranty expressly stated in the applicable invoice or project agreement. Unless that document says otherwise, manufacturer warranty coverage does not automatically include TN Pools labour, travel, removal, reinstallation, water, chemicals, landscaping or freight.
To the extent permitted by law, warranty coverage may be denied for damage caused by misuse, neglect, improper water chemistry, freezing, failure to winterize, unauthorized repair or modification, improper electrical or gas supply, failure to follow instructions, normal wear, ground or deck movement, external impact, animals, vandalism, fire, flood, storm or other causes outside the warranted product or workmanship. Nothing in this section excludes a warranty or remedy imposed by law.
Pools and hot tubs require ongoing circulation, filtration, testing, balancing, cleaning and seasonal care. Unless the customer has purchased a service that expressly includes these tasks, ongoing maintenance remains the customer’s responsibility after installation or service.
Improper water balance, insufficient circulation, untreated water, failure to follow dosing instructions, mixing incompatible products, freezing or failure to complete required opening or closing preparation may damage liners, finishes, covers, heaters, pumps, filters, salt systems, plumbing and other equipment. Chemicals used beyond those expressly included in a service package may be billed separately with the customer’s authorization.
A service call or diagnostic fee covers the time and scope stated when booked; it does not guarantee that every issue can be repaired during the initial visit. Hidden, intermittent or multiple faults may require additional testing, parts or return visits. TN Pools will seek authorization before performing material additional work or installing chargeable parts, except as otherwise permitted by the service agreement or law.
Financing is offered by independent third-party providers and is subject to their approval, rates, disclosure documents and agreements. TN Pools does not guarantee approval or the accuracy of an illustrative payment amount until confirmed by the financing provider. Payment obligations to TN Pools remain subject to the applicable sale or project agreement. Third-party delivery, payment, financing, app, manufacturer and warranty services may also be governed by their own terms and privacy practices.
You may use TN Pools websites and online stores only for lawful personal or business purchasing purposes. You must not interfere with site security, attempt unauthorized access, introduce malicious code, scrape the site unreasonably, impersonate another person, submit false information or use the site for fraudulent activity.
TN Pools may limit quantities, decline transactions, suspend access or investigate activity that reasonably appears fraudulent, abusive, automated, unsafe or unlawful. Website availability is not guaranteed and may be interrupted for maintenance, security or technical reasons.
Website articles, calculators, guides, product descriptions and general recommendations are provided for general information. They are not a substitute for site-specific inspection, engineering, municipal approval, manufacturer instructions or professional safety advice. Customers must confirm compatibility, dimensions, electrical requirements, plumbing requirements and intended use before purchasing or installing a product.
TN Pools website content, branding, original text, graphics, layouts, photographs and other materials are owned by or licensed to TN Pools and are protected by applicable intellectual-property laws. They may not be copied, republished, sold, modified or commercially exploited without written permission, except for ordinary personal use or as otherwise permitted by law.
TN Pools may collect and use contact, order, property, service and payment-related information to respond to inquiries, prepare quotes, process transactions, schedule work, provide service, administer warranties and meet legal obligations. Commercial electronic messages will be sent in accordance with applicable consent and unsubscribe requirements. Transactional messages relating to an inquiry, order, appointment, safety notice or warranty may still be sent where permitted by law.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability arising from TN Pools’ fraud, wilful misconduct or any other liability that applicable law requires TN Pools to bear.
To the fullest extent permitted by law, TN Pools is not liable for indirect, incidental, special, punitive or consequential loss, including loss of use, enjoyment, revenue, business opportunity or anticipated savings, arising from a product, service, delay, website or third-party service.
To the fullest extent permitted by law, TN Pools’ aggregate liability for a claim is limited to the amount paid to TN Pools for the specific product or service giving rise to that claim. This limitation does not reduce any minimum remedy or other right guaranteed by applicable consumer law.
To the extent permitted by law, the customer is responsible for loss, damage or third-party claims caused by the customer’s unlawful conduct, material breach of these Terms, unauthorized modification, misuse of a product, failure to follow safety instructions or undisclosed site hazard. This section does not require the customer to compensate TN Pools for loss caused by TN Pools’ negligence, breach of contract or other legal fault.
If you have a concern, please contact TN Pools promptly with your name, order or invoice number, a description of the issue and relevant photographs. The parties will attempt in good faith to understand and resolve the concern before starting formal proceedings, where practical.
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. Subject to any mandatory consumer right or jurisdiction rule, disputes may be brought before the courts or tribunals with lawful jurisdiction in Ontario. Nothing in these Terms requires a consumer to waive a legally protected court, class-proceeding or other procedural right.
TN Pools may update these Terms for future transactions by posting a revised version and changing the effective date. The Terms in effect when an order or agreement is entered into will generally continue to govern that transaction unless the parties validly agree otherwise or the law requires a change. TN Pools will not retroactively make a material adverse change to an existing consumer contract without the consent or notice required by law.
